Welcome to QOVI. These Terms of Service ("Terms") govern your access to and use of the QOVI mobile application ("App"), website, and related services (collectively, the "Service") operated by Qovi Technologies ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By creating an account, accessing, or using QOVI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the revised Terms.
You must be at least 18 years of age to use QOVI. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service under any circumstances.

QOVI does not provide medical advice, diagnosis, or treatment. The analysis, scores, and suggestions provided by the Service are for informational and entertainment purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare professional or licensed aesthetician before making any decisions related to medical or cosmetic procedures.
The Service uses artificial intelligence, including third-party AI models, to generate analyses and recommendations. AI-generated results may be inaccurate, incomplete, or biased. We do not guarantee the accuracy, reliability, or completeness of any analysis, score, or recommendation provided by the Service.
We make no guarantees regarding the outcomes of following any suggestions or recommendations provided by the Service. Individual results will vary.
QOVI offers a limited free tier that includes a restricted number of scans and basic metric access. Features available in the free tier may change at our discretion.
QOVI Pro is a premium subscription that provides access to advanced features including unlimited scans, full metric breakdowns, cephalometric measurements, AI improvement suggestions, progress tracking, and shareable report cards. The current subscription price is $3.99 per week, billed through in-app purchase via the Apple App Store or Google Play Store.
Subscriptions are billed on a recurring weekly basis. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.
We reserve the right to change subscription pricing at any time. If we change pricing, we will provide notice through the App or by other means. Price changes will take effect at the start of the next billing period following the date of the price change.
Refunds are handled according to the policies of the Apple App Store or Google Play Store, as applicable. We do not directly process refunds for in-app purchases. To request a refund, please contact the relevant app store.
Subscription payments are processed through Apple's App Store, Google Play Store, and/or RevenueCat (our subscription management platform). By subscribing, you also agree to the terms of these third-party payment processors.
QOVI may offer a referral program that allows users to earn rewards by inviting others to use the Service. Referral program terms, rewards, and eligibility may be modified or discontinued at any time at our sole discretion. We reserve the right to revoke referral rewards in cases of fraud, manipulation, or violation of these Terms. Specific referral program terms will be provided within the App when available.
You retain ownership of any photographs, images, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, store, and analyze your User Content solely for the purposes of providing and improving the Service.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.
The Service, including its design, features, algorithms, analyses, reports, text, graphics, logos, icons, and software, is owned by Qovi Technologies and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation or attribution to you.
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. Given the sensitive nature of facial biometric data, we encourage you to review our Privacy Policy carefully.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any facial analysis, score, measurement, or recommendation provided by the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QOVI TECHNOLOGIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Qovi Technologies and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any User Content you submit to the Service.
You may terminate your account at any time by deleting your account through the App settings or by contacting us at support@qovi.app. Termination of your account does not entitle you to a refund of any subscription fees already paid.
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or extended periods of inactivity.
Upon termination, your right to use the Service will immediately cease. We may delete your account data, including uploaded photographs and analysis results, in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9, 13, 14, 15, and 18.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles.
Before initiating any formal dispute resolution, you agree to first contact us at support@qovi.app and attempt to resolve any dispute informally for at least 30 days.
Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Qovi Technologies regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, or failures of third-party services.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms within the App and updating the "Effective Date" above. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
